The plaintiff, Charles R. Ventura, III, appeals from the district courts summary judgment dismissal of his tort action against his employer, Albertsons, Inc., and certain of his co-employees for assault and battery, intentional infliction of emotional harm, and false imprisonment arising out of a physical altercation at an Albertsons store. The district court determined that the action is barred by the exclusivity provisions of the Workers Compensation Act, Â§ 8-40-101, et seq., C.R.S. (1992 Cum. Supp.). We agree and affirm the judgment of dismissal.
